1. Agreement
This End User License Agreement ("Agreement") is a legal agreement between you and the developer named in section 2 ("we", "us") for SS1 Tool for Windows and SS1 Tool for Android, including their updates, scripts and documentation (together, the "Software").
By ticking the agreement boxes, clicking "I agree", or downloading, installing, buying, activating or using the Software, you agree to this Agreement. If you don't agree, don't download, install or use the Software. If you are using the Software for someone else, you confirm you may accept this Agreement for them.
You must be 18 or older, or have the permission of a parent or legal guardian who agrees to this Agreement for you.
2. Who we are
The Software is made and licensed by f3bandit, an independent individual developer who sells it under the name F3 Digital Systems. F3 Digital Systems is a trading name, not a separate company. Contact details are in section 19.
3. Unofficial tool, trademarks
The Software is an independent, unofficial community tool. It is not made, endorsed, sponsored or supported by Taki Udon, Retro Remake, the MiSTer project, Microsoft or Google, and we have no business relationship with them. SuperStation One, MiSTer, Windows, Android and all other names are trademarks of their owners and are used only to say what the Software works with. Updates by those parties may change or break how the Software works, and we are not responsible for that.
4. Your license
The Software is licensed, not sold. We and our licensors keep all rights, title and interest in it. Subject to this Agreement, we give you a limited, personal, non-exclusive, non-transferable, revocable license to:
- SS1 Tool for Windows (free): install and use it on computers you own or control, for personal, non-commercial use.
- SS1 Tool for Android (paid, sold only on Google Play): install and use it on Android devices signed in to the Google account you bought it with, as Google Play allows, for personal, non-commercial use.
Open-source components included in the Software are licensed under their own licenses, which are listed in the Software. Nothing in this Agreement limits your rights under those licenses.
5. Buying on Google Play
- SS1 Tool for Android is sold only on Google Play. No license key is used: your purchase is linked to your Google account, and the app gets updates from Google Play.
- Google Play's own terms (the Google Play Terms of Service) also apply to buying, downloading and updating the app. If they conflict with this Agreement about the purchase itself, Google Play's terms apply. This Agreement is between you and us, not Google, and we, not Google, are responsible for the app.
6. What you may not do
Except where the law gives you a right we can't take away, you may not:
- copy, share, distribute, sell, rent, lend or sublicense the Software or SS1 Tool for Android's installation file (APK);
- bypass Google Play's purchase or distribution of SS1 Tool for Android, or help anyone else to;
- modify, decompile, reverse engineer or make derivative works of SS1 Tool for Android;
- remove copyright, trademark or license notices;
- use the Software on devices or networks you don't own or aren't allowed to access, or for anything unlawful;
- use the Software to download, copy or share games, BIOS files or other material you don't have the right to use.
7. Your responsibility
The Software connects to your SuperStation One over your network with the login you give it, and can, at your request:
- change system settings, video settings and configuration files;
- install, update and run scripts, including third-party scripts and Update All;
- copy, move, rename and delete files;
- restart, reset or shut down the SuperStation;
- (Windows) erase, partition and flash SD cards and other drives, and back them up or restore them.
You use the Software at your own risk, and you are solely responsible for: your SuperStation One, computers, phones, SD cards, drives, displays and other equipment; your data, files, saves and settings; making and keeping backups before using the Software; checking that you selected the right device, drive or file before any action; your network and its security; and any consequences of the actions you choose to take with the Software, including data loss, a SuperStation that needs reflashing, display problems, or damage to or loss of use of any equipment.
Features such as automatic undo of video changes, backups and safety checks are provided to help you, but may not work in every case. You must not rely on them in place of your own backups.
8. Third-party content and services
The Software can use or download things made by other people: Update All, MiSTer distributions, cores, community scripts, the SS1 SD Card Installer, and services such as GitHub, RetroAchievements, TheGamesDB and Google Play. These are provided by their owners under their own terms. We don't control them, we aren't responsible for them, and we make no promises about them. You choose whether to use them.
The Software does not include or provide any games, BIOS files or other copyrighted content. You are responsible for having the right to use any such content on your SuperStation.
9. Reports and logs
Debug reports and app problem reports are created on your device and are never sent anywhere automatically. The Software removes passwords, keys, network names and addresses that it recognises, but this is done on a best-effort basis and may miss something. Before you share a report anywhere, you are responsible for reading it and removing anything you don't want to share.
10. Updates and support
We may, but don't have to, provide updates, fixes or support, and we may change or remove features. Updates are covered by this Agreement unless they come with different terms. We may stop developing or offering the Software at any time; a copy you already have keeps working, but may stop working with future SuperStation, MiSTer, Windows or Android versions.
11. Supported Android versions
SS1 Tool for Android supports Android 8.0 (Oreo) and newer and is tested up to Android 16. It can't be installed on older versions. A future update may raise the minimum Android version. From then on, Android versions below the new minimum are no longer supported: the copy of the app you have keeps working, but it won't get updates or fixes for those versions. A change to the minimum is listed in the release notes. Being unable to install future updates on an older Android version is not a reason for a refund after the refund period.
12. No warranty
The Software is provided "as is" and "as available", with all faults and without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty that the Software will be uninterrupted, error-free, secure, compatible with your devices or free of harmful effects, or that any defect will be corrected.
Information in the Software (for example about video settings, BIOS files or updates) comes from public documentation and the community and may be incomplete, outdated or wrong for your setup.
13. Limitation of liability
To the fullest extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, files, saves, settings, profits, revenue, goodwill or use, any damage to or loss of use of any equipment (including your SuperStation One, computers, phones, SD cards and drives), any cost of replacement or repair, or any cost of reflashing, recovery or substitute products, arising out of or related to the Software or this Agreement, however caused and on any theory of liability, even if we were told of the possibility of such damages.
Our total liability for all claims arising out of or related to the Software or this Agreement will not exceed the amount you actually paid us for the Software in the 12 months before the claim, or US$5 if you paid nothing.
These limits apply even if a remedy fails of its essential purpose. Some places don't allow some of these exclusions or limits; in those places, they apply to the fullest extent allowed, and nothing in this Agreement limits liability that can't be limited by law (for example for fraud, or for death or personal injury caused by negligence where that can't be excluded).
14. Indemnity
To the extent allowed by law, you agree to defend, indemnify and hold us harmless from any claims, losses, damages and costs (including reasonable legal fees) brought by a third party that arise from your misuse of the Software, your breach of this Agreement, or your violation of any law or anyone else's rights.
15. Termination
This Agreement applies until it ends. You may end it at any time by deleting the Software. It ends automatically, without notice, if you break it. When it ends, you must stop using and delete the Software. Sections 3, 6–9 and 12–18 continue to apply after it ends.
16. Payments and refunds
SS1 Tool for Android is sold only on Google Play; Google handles payment and taxes under Google Play's terms. Refunds are covered by our Refund Policy. A refund ends your license.
17. Governing law
This Agreement is governed by the laws of the State of Ohio, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Ohio, and you and we agree to their jurisdiction. If you are a consumer living outside the USA, you keep any protections given to you by the mandatory laws of the country you live in. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You agree to use the Software in line with all applicable export control and sanctions laws.
18. General
- Changes. We may update this Agreement. The new version applies to versions of the Software released with it; the apps ask you to accept it before you keep using them. The version and date are shown at the top of this page.
- Whole agreement. This Agreement, the Privacy Policy and the Refund Policy are the whole agreement between you and us about the Software.
- Severability. If any part of this Agreement can't be enforced, it is limited or removed only as much as needed, and the rest stays in effect.
- No waiver. If we don't enforce a term, that doesn't mean we give up the right to.
- Assignment. You may not transfer this Agreement. We may transfer it, for example if the Software is taken over by someone else.
